Frequent Modifications as business model evolves
As we establish and fine-tune the EduWizardS business model the number of half hour free trials a student can take as well as many other features and terms may be frequently modified. Our agreement with tutors, including financial and other terms of that agreement, may also be frequently modified. As below, many other features and terms may also be frequently modified.

Changes to Terms of Use
EduWizardS reserves the right, from time to time, with or without notice to you, to change these Terms of Use in our sole and absolute discretion. The most current version of these Terms of Use can be reviewed by clicking on the "Terms of Use" located at the bottom of the home page of the EduWizardS Web site. The most current version of the Terms of Use will supersede all previous versions. Any such modifications will become effective immediately upon posting to the site and your continued use of the site, Services and/or Software constitutes your agreement to be bound by such changes. The terms may be modified as frequently as desired, and at the company's sole and absolute discretion.

Right to Terminate
We reserve the right to terminate or restrict a registered user's (student's or tutor's) use of our website or services, without notice, for any reason or for no reason whatsoever.

Modifications to the Service
EduWizardS may add, change or eliminate features, pricing, nomenclature and other aspects of the Services and make other changes at any time and these Terms will continue to apply to the Services as modified. We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, the site or the Services (or any part thereof) with or without notice. You agree that we will not be liable to you or to any third party for any such modification, suspension, or discontinuance of the site or the Services. The modifications may be modified as frequently as desired, and at the company's sole discretion.

Must be over 18
You must be 18 years of age or older to take tutoring (free trials or paid tutoring) or perform any other transactions at EduWizardS. If you are under 18 you must take permission from a parent or legal guardian before performing any transactions.

Transactions with Tutors
Tutors in our database have not been screened. EduWizardS is not responsible for the accuracy or legitimacy of the information provided by registered tutors. EduWizardS can neither confirm nor deny the validity of the information associated with each registered tutor. When you find a tutor who matches your tutoring needs, IT IS YOUR RESPONSIBILITY TO CONDUCT ANY AND ALL BACKGROUND AND REFERENCE CHECKS.

Any opinions, advice, statements, services or other information that that is provided to you by a tutor is only that of the tutor and not of EduWizardS, or its shareholders, directors, officers, or employees. Under no circumstances shall EduWizardS or its shareholders, directors, officers, directors, or employees be held liable for any loss or damage caused by your reliance on information obtained from a tutor. It is your responsibility to evaluate any information, opinion, statements, services or advice provided by the tutor.

If you have a dispute of any kind with one or more tutors, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

Student/parent Review of Tutors
Students and parents are asked to provide a review (1 to 5 stars) with text comments, for each session they take with a tutor (free trial or paid).

As an EduWizardS member, student/parent should use caution, good judgment and proper language when leaving a Review for a tutor. What you post will be a permanent part of that tutor's record. Please restrict your review to a tutor's teaching-related skills (communication skills, knowledge, patience, clarity etc.)

Tutors are not permitted to discuss Reviews with students/parents or to make any comments or suggestions to student/parent regarding any future or past Review.

Because EduWizardS does not censor Reviews or investigate them for accuracy, EduWizardS is not legally responsible for the remarks that students/parents post, even if those remarks are defamatory.

Conditions for becoming a tutor
To tutor at EduWizardS a Bachelor's higher degree is required. In addition tutor's knowledge of the subject must be thorough and tutor should plan to teach only the subject(s) he/she knows best. Anyone with these basic qualifications is welcome to open an account as a (prospective) tutor, browse and understand how our website works, and submit their Resume and fill in and submit their Profile for approval. Tutors whose profiles are approved are ready to tutor on our website. ONLY SELECTED TUTORS WILL BE APPROVED. Selection of tutors is solely at our discretion and we do not divulge all our criteria.

Tutors and prospective tutors will be required to certify that all information they provide in their Resume/Profile is true and correct to the best of their knowledge. We reserve the right to verify any information in a tutor's Resume or Profile from third parties and to administer to tutor or prospective tutor any Subject(s) or other test/interview at any time (before or after profile approval). At any time we can remove a tutor, at our sole discretion, for any reason or for no reason at all.

Trademark Notice
The trademarks, service marks, and logos (the "Trademarks") used and displayed on the site or in any Company Content are registered and unregistered Trademarks of us and others and are protected, without limitation, pursuant to New Delhi, India, U.S. and foreign trademark laws. Nothing on the site, the Services or otherwise should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on the site or in connection with the Services, Company Content or Software, without the written permission of the applicable Trademark owner. We aggressively enforce our intellectual property rights to the fullest extent of the law. You may not use the Trademarks in any way without our prior written permission.

The EduWizardS web site allows you and other third parties to post comments, give feedback concerning the services offered, our tutors, and subject content distributed by us. Any opinions, advice, statements, services, offers, or other information that constitutes part of the content expressed or made available by third parties on the EduWizardS Web site are those of the respective authors or producers and not of EduWizardS or its shareholders, directors, officers, or employees. Under no circumstances shall EduWizardS or its shareholders, directors, officers, directors, or employees be held liable for any loss or damage caused by your reliance on information obtained through the EduWizardS Web site. It is your responsibility to evaluate the information, opinion, advice, or other content available through the EduWizardS Web site.

You agree not to use the site, the Services or the Company Content to recruit, solicit, or contact in any form Tutors or potential Consumers for employment or contracting for a business not affiliated with us without our advance written permission.

Other Disclaimer of Warranty & Limitations
The company content, the site, the services and each portion thereof are provided "as is" without warranties of any kind either express or implied. To the fullest extent possible pursuant to applicable law, we disclaim all warranties, express or implied, with respect to the site, the company content, the services and each portion thereof, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or other violation of rights. We do not warrant or make any representations regarding the use, validity, accuracy, or reliability of, or the results of the use of, or otherwise respecting, the company content, the site, the services, each portion thereof or any third party sites.

Under no circumstances, including, but not limited to, negligence, shall we or third parties be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the company content, the site, the services or any portion thereof, even if we or our authorized representative has been advised of the possibility of such damages. Any notice or other communication to be given hereunder will be in writing and given by facsimile, postpaid registered or certified mail return receipt requested, or electronic mail. Nothing in these Terms shall be construed as making either party the partner, joint venture, agent, legal representative, employer, contractor or employee of the other. Neither party shall have, or hold itself out to any third party as having, any authority to make any statements, representations or commitments of any kind, or to take any action that shall be binding on the other except as provided for herein or authorized in writing by the party to be bound.
